The Denver-based 10th U.S. Circuit Court of Appeals has already ruled in Summum’s favor, saying the rejection constituted viewpoint discrimination. If the Supreme Court upholds the 10th Circuit decision, Summum plans to place a stone monument similar to the Ten Commandments marker. Summum is arguing its case based on free-speech rights.
